Trade Body in US Backs Bombardier Versus Boeing

28 January 2018

This allowed Bombardier to sell the planes to Delta at unfairly low prices, which was harmful to Boeing's business, according to the aerospace giant.

Delta Air Lines also came out with a statement saying, "Delta is pleased by the U.S. International Trade Commission's ruling rejecting Boeing's anti-competitive attempt to deny U.S. airlines and the U.S. traveling public access to the state-of-the-art 110-seat CS100 aircraft when Boeing offers no viable alternative". As a result of the decision, the U.S. Commerce Department will not collect a penalty from Bombardier.

Bombardier, which is headquartered in Canada, said in a statement: "Today's decision is a victory for innovation, competition, and the rule of law".

"While we disagree with the ITC's conclusion today, we will review the Commission's more detailed opinions in full as they are released in the coming days", Boeing said.

Boeing had complained to USA authorities that the C-series jets were being sold to the United States airline Delta below their production cost and had been given illegal subsidies from the UK and Canadian governments.

In the commercial, a Burger King cashier charges exorbitant amounts for slow, lackluster service to the frustration of customers. Introduce the kind of dumb policy that Burger King applies in the video , and you'd lose all your customers overnight.

Bombardier also argued that the commission should reject the petition in part due to its new partnership with Airbus SE, which will see the European planemaker take control of the CSeries program and assemble US -bound jets in a facility in Alabama.

"The U.S. values its relationships with Canada, but even our closest allies must play by the rules", Commerce Secretary Wilbur Ross said in announcing the plans to seek triple-digit duties in the case. The company can now proceed with the delivery of 75 CSeries jets to Delta Air Lines, originally scheduled to begin in the spring. "It also removes any concerns about potential future orders in the U.S".

The decision was surprising, said Richard Aboulafia, vice president at Teal Group because it broke with the Commerce Department's recommendation for tariffs.

Delta said Friday it was pleased with the ruling "rejecting Boeing's anti-competitive attempt to deny US airlines and the USA traveling public access to the state-of-the-art 110-seat CS100 aircraft when Boeing offers no viable alternative".

It alone is responsible for the design, manufacture and assembly of the advanced composite wings for every CSeries aircraft. The ITC's ruling "is not the final stage in this process", he said.

Analysts said Boeing's bid for help ultimatelyfell short because the company overreached, asserting an unsupported injury claim.

Still, he said, workers will be holding their breath as they wait to see if Boeing appeals the decision.

Boeing's failure to prove the "threat of harm" is a major setback both for the company and the 737-700 and MAX 7 products. "That's why Bombardier is willing to lose millions of dollars per plane on this sale". On Tuesday, the administration imposed tariffs on imported solar-energy components and large washing machines. Its class B shares ended up more than 15% at C$3.34.

For Boeing, the verdict will redouble the pressure it faces to strike a deal with Embraer, whose E-jet family competes head-on with Bombardier. "It is also a victory for United States airlines and the USA travelling public", Bombardier said.
