Cosby accuser to resume testimony in sex assault trial

23 June 2017

Even Judge Steven T O'Neill and the defence lawyers of the legendary comedian did not know that she would testify so early in the trial.

The other was a voicemail left by Cosby's powerhouse attorney, Marty Singer, asking her mother to call to discuss an "educational fund" for her daughter.

She met Cosby at Temple University in Philly where he was one of its most famous alumni and Constand was director of basketball operations. "I wanted it to stop", Constand said.

Cosby, 79, is charged with three counts of aggravated indecent assault for allegedly drugging and sexually assaulting the former Temple University employee in January 2004 at his mansion in Elkins Park, Pennsylvania.

Cosby, once beloved by American audiences as the dad in the long-running TV hit "The Cosby Show" is not charged in the Johnson incident.

Cosby's lawyers have tried to poke holes in her story, citing differences between her courtroom testimony and the accounts she gave police and in a lawsuit in 2005.

Cosby's defense team argues that Constand and prosecutors are misrepresenting what occurred that day and that the sexual activity was consensual, which Constand and prosecutors reject. Shortly after, Constand remembers feeling "frozen", slurring her words, and experiencing blurred vision. Constand also said she stayed in contact with Cosby because she feared for her job. Cosby leaned in to listen, whispered to his lawyer and shook his head.

Before today, Constand had never spoken about Cosby in public, barred from doing so under the terms of a confidential settlement they reached in 2006.

Damage Control?: The prosecution introduced into evidence two calls Cosby's team made after Constand and her mother confronted him about the the encounter in question.

When she asked if they were herbal, he nodded, she said. She woke to him fondly her breasts and penetrating her with his fingers, she testified.

"I trusted him. I wasn't scared of him in any way", said Constand.

He gave her wine as well, she said.

Jurors heard she lost consciousness and awoke to discover him sexually assaulting her, but that the drugs had left her unable to fight him off. He told a radio station last month that he will not testify, "What people want to say, want you to say, and how they maneuver-yes, I do have lawyers to protect me, "objections, ' 'sustained"-but I just don't want to sit there and have to figure out what I believe is a truthful answer as to whether or not I'm opening a can of something lawyers are scrambling".

"He said these will help you relax", she told jurors. "In my head, I was trying to get my hands to move, or my legs to move".

"It had more to do with business than it did with me personally", she said. Both times, Constand said, she made it clear she didn't welcome the behavior.

Upon leaving the courtroom, Cosby laughed and said "Hey, Hey, Hey", his Fat Albert catchphrase, apparently in reply to an onlooker who was singing the theme song from the 1970s cartoon.

She told the court she felt "really humiliated" after the alleged attack. I realized he was not going to tell me what he gave me that night. Because of that trust, Constand said she took the pills despite reservations.

Agrusa went through phone records that showed Constand's calls to Cosby after the alleged incident.

Constand claimed Cosby assisted her to the couch and laid her down, and that she doesn't recall passing out. Johnson testified on Monday that the alleged assault happened in 1996.

"I was mistaken", she said, unflustered. Constand told her Cosby returned from the dinner table in his home that night and opened his hand to show her three blue pills. "I thought I was having a bad reaction and I was panicking a little bit, but I knew I couldn't really get up and go anywhere at the same time because my legs were rubbery".
